PRIVACY NOTICE
In compliance with the Federal Law on Protection of Personal Data in Possession of Private Parties (the “Law”), their regulation and other applicable regulations, we provide you this Integral Privacy Notice, and inform you of the following:
1. Data controller.
Daniela Montemayor Zermeño, also commercially known as Montéz Joyería (hereafter “Montéz”), with address on Av. Residencial Chiluca 315, Col. Residencial Chiluca, Atizapán de Zaragoza, Estado de México, CP. 52930, and who individually will be data controllers, depending on the case, the data processing and protection of personal data that we collect from you.
2. Information about our Data Protection Officer and how to contact him.
Our Data Protection Officer (the “DPO”) is the person inside Montéz who in compliance with the article 30 of the Law, has been formally designated to:
- Attend the requests of the data subjects for the exercise of their rights of access, rectification, cancelation and opposition (the “ARCO Rights”); and
- Promote and encourage the protection of the personal data that we collect from you.

3. Personal Data collected.
In order to carry out the purposes indicated in section 4 (four) of this Privacy Notice, we will collect the following categories of personal data from each of the types of data subjects indicated below:

a) Identifying;
b) Contact;
c) Electronic; and
d) Banking.
WE DO NOT COLLECT SENSITIVE PERSONAL DATA
The personal data collected may be processed by Montéz for up to 5 (five) years after the legal relationship has ended, at the end of this period will be blocked for 6 (six) more months, and then proceed to its final cancellation.
4. Purposes of the data processing of the personal data collected.
The personal data is collected from you for the following primary purposes, that is, those that give rise to and are necessary to develop the legal relationship between the data subject and Montéz, depending on the type of data subject, as follows:
- Contact you;
- Identify you as a Montéz client; and
- Follow up on the punctual fulfillment of the obligations contracted between you and Montéz,
The secondary purposes, that is, those that do not give rise to a legal relationship between you and Montéz, are of utmost importance and useful to provide you with a better service and promote us, in all cases, will be the following:
- Evaluating the quality of the services and/or benefits we provide you; and,
- Marketing, advertising and commercial prospecting.
5. Denying of the data processing for the secondary purposes.
In case you do not want your personal data to be processed for the secondary purposes mentioned above or any of them, you can deny us your consent from this moment by sending your request to our DPO, who will indicate the procedure to follow to exercise your right. Your denial in this regard may not be a reason for us to refuse you the services you request or to contract with us.
6. Transfers of personal data.
Your personal data may be transferred only to natural or legal persons under the article 37 of the Law, without your consent being legally required, that is when the transfer:
- Is provided in the Mexican legislation or in any international agreement or convention in which Mexico is a part of;
- Be necessary for the attention, diagnosis or medical treatment of the data subject;
- Is carried out within the entities that integrated the corporate group of Montéz;
- Is necessary under a contract celebrated or to be celebrated in interest of the data subject, by Montéz and a third party.
- Is legally required for the administration or pursuit of justice or the safeguarding of the public interest.
- Is necessary for the recognition, defense exercise of a right before the jurisdictional authorities.
- Is necessary for the maintenance or compliance of the legal relationship between the data subject and Montéz.
In this sense, we must point out that your personal data may also be made available to the competent authorities if any action is detected that could constitute an illegal act or by express requirement properly founded and motivated.
Therefore, only the personal data of our Customers may be transferred to third parties when entering into an agreement for the assignment of collection rights, in the event of any type of contractual breach.
7. ARCO Rights.
Under the terms of the applicable regulations, you have the right to know what personal data we have about you, what we use it for and the conditions of the use we give them (access). Likewise, it is your right to request the correction of your personal data in case it is out of context, inaccurate or incomplete (rectification); that we remove it from our records or databases when you consider that it is not being properly processed (cancellation); as well as to oppose the use of your personal data for specific purposes (opposition). These rights are known as ARCO Rights.
To exercise any of the ARCO Rights, you must submit the respective request via email to our DPO or in writing at Montéz’s address, in order to be informed in more detail about the procedure and requirements for the exercise of the ARCO Rights, response times, how we will enforce your rights and address any questions, complaints or comments you may have in this regard. Nevertheless, it is necessary to consider the following:
- For the exercise of your ARCO Rights, you or your legal representative must identify yourself through an official document issued by your country government and that is in force.
- Our DPO will respond your request to exercise your ARCO Rights during the next 20 (twenty) business days after you submit it, informing the other terms that are relevant to each case.
- The answer from our DPO always will be by email authorized and informed to you in the present Privacy Notice.
- The documentary reproduction containing the information resulting from the exorcise of your ARCO Rights, will be obtained free of charge through an electronic document. However, if you require it to be provided in another modality, please let us know in the first contact with our DPO.
8. Mechanisms and procedures to revoke consent.
Under the applicable law, you may revoke the consent that you may have granted us; however, it is important to note that not in all cases your request will be admissible or we can conclude the treatment immediately, since it is possible that for some legal obligation we require to continue processing your personal data.
With the sole purpose of attending you in a personal way and assisting you to resolve any questions that may arise: to revoke your consent, you must submit your request via email to our DPO or in writing at Montéz’s address, where you will be informed about the procedure and requirements for the exercise of this right, deadlines for response, the way in which we will enforce your right and will address any questions, complaints or comments you may have in this regard.
9. Options available to the data subject to limit the use or disclosure of personal data.
In addition to the procedure and exercise of the rights set forth in section 6 (six) of this Privacy Notice, you may limit the use or disclosure of personal data, as follows:
- For emails that we send you for promotional, marketing and/or advertising purposes, you may stop receiving them by sending your request to the following email: daniela@montezjoyeria.com , which will be included in each such email; and,
- Montéz has an opt-out list managed by our DPO, with whom you may communicate directly, through the previously informed e-mail, and let him know your decision.
10. Modifications to this Privacy Notice.
We reserve the right to effectuate, at any moment, modifications or updates to the present Privacy Notice, attending to the new legislation, internal policies or new requirements to the presentation and offer of our services. We will inform you about the updated version through the following means:
- On our website, which we suggest you visit frequently; or,
- Through the last email that you provided us.
The procedure regarding the notification via our website is as follows: (i) access our website www.montezjoyeria.com , in case there are modifications or updates to this Privacy Notice, there will be a notification to let you know; (ii) access the Privacy Notice link; (iii) there you will find the current version with the date of the most recent update.
11. Use of cookies and web beacons.
We inform you that we have electronic technologies (cookies and web beacons), which allow us to collect data about your activity automatically and simultaneously, while you contact us through our website www.montezjoyeria.com.
The data we collect is the following:
- Information on the type of browser you use;
- Information on the time and duration of your visit to our site;
- Sections consulted in our page;
- Information of the pages you visited prior to entering www.montezjoyeria.com;
- Information about the pages you visited after you visited www.montezjoyeria.com; and
- Your IP address.
The data collected are useful for marketing and advertising purposes; they will be for the exclusive use of Montéz’s; therefore, they will not be subject to national or international transfers. 12. Improper Data Processing of your personal data.
If you consider that your right to the protection of your personal data has been violated for any conduct or omission on our part, or presume any violation to the provisions of the Law and other applicable regulations, you may file a complaint to the National Institute of Transparency, Access to the Information and Protection of Personal Data (INAI, Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales) located at 321 Insurgentes Sur Av., Insurgentes Cuicuilco, Coyoacán, Z.C. 04530, Mexico City, Mexico.
13. Consent.
I give my free, unequivocal, specific and informed consent for my personal data to be processed under the terms and in compliance with this Privacy Notice.
